JBC to amend Sec. 5, Rule 4 of its Rules?

The Judicial and Bar Council (JBC) will conduct public consultations on September 8, 9, and 12 , 2011, 9:30 a.m. – 12:00 noon, at the Division Hearing Room, Ground Floor, Main Bldg., Supreme Court, P. Faura St., Manila, on the following proposed amendment to Section 5, Rule 4 of theRules of the JBC (JBC-09), as amended:

Sec. 5. Disqualification. – The following are disqualified from being nominated for appointment to any judicial post or as Ombudsman or Deputy Ombudsman:

  1. Those with pending criminal or regular administrative cases, IF IN THE DETERMINATION OF THE COUNCIL, THE CHARGES ARE SERIOUS OR GRAVE AS TO AFFECT THE FITNESS OF THE APPLICANT FOR NOMINATION;
  2. Those with pending criminal cases in foreign courts or tribunals;
  3. Those who have been convicted in any criminal case; and
  4. THOSE WHO HAVE BEEN FOUND GUILTY in an administrative case FOR THE FOLLOWING OFFENSES unless they have been granted clemency BY THE OFFICE OR AGENCY WHICH IMPOSED THE ADMINISTRATIVE SANCTION:
  5. SERIOUS OFFENSES OR WHERE THE PENALTY IMPOSED IS AT LEAST A FINE OF MORE THAN P20,000;
  6. OFFENSES WHERE THE PENALTY IMPOSED IS SUSPENSION WHICH WOULD INVOLVE DEPRIVATION OF SALARY EQUIVALENT TO MORE THAN Php20,OOO AS OF THE TIME THE PENALTY WAS IMPOSED; OR
  7. OTHER OFFENSES WHEN IT AFFECTS THE FITNESS OF THE APPLICANT FOR NOMINATION.
