SC lets Congress get 2 votes in JBC - The Philippine Star » News » Headlines

In a resolution, the SC said the setup stays until it decides on a motion to reconsider the High Tribunal’s July 17 ruling limiting Congress’ vote in the JBC to one.
The deferment of the ruling will allow justices aiming for the top SC post to join deliberations on the appeal filed by Congress.

“The Court finds it more equitable for the present members of the JBC to resume their task of selecting nominees for the vacant position of the chief justice,” the SC said in its three-page resolution.

“Accordingly, pending the final resolution of this petition, Senator (Francis) Escudero and Congressman (Niel) Tupas Jr., in their capacities as representatives of Congress, may simultaneously sit as ex-officio members of the JBC and exercise the functions flowing therefrom,” it said.


After holding oral arguments last Thursday on Congress’ appeal, nine justices unanimously agreed to allow Escudero and Tupas to have separate votes in the council. Sen. Joker Arroyo represented Congress in the oral arguments.
“The Court finds it in the best interest of justice that all its present members, including those who in the meantime have inhibited themselves, be given the opportunity to take part in the final deliberations and resolution of this petition,” the SC resolution read.
