PNoy: Judiciary needs wide-ranging reform | ABS-CBN News

MANILA, Philippines - President Benigno Aquino on Wednesday said there is a need for a wide-ranging reform in the judiciary, citing delays in the resolution of certain cases and questioning certain decisions of lower courts in notable cases.

In the speech he delivered after receiving an honorary law doctorate from the Centro Escolar University, Aquino mentioned the case filed by National Commission on Muslim Filipinos chair Bai Omera Lucman questioning Aquino's Executive Order number 2 over the issue of midnight appointments.

"Tingnan na lamang po natin itong kaso ni Bai Omera Lucman ng National Commission on Muslim Filipinos. Naglabas ang Korte Suprema ng status quo ante order at hinayaang manatili siya sa pwesto. Natapos na ang termino niya, pero hanggang ngayon, hindi pa rin dinidinig ang kaso. May ebidensya rin kami na magpapatunay na hindi lang siya midnight appointee, kundi post-midnight appointee pa po," Aquino said.

He said that the Constitution mandates that cases brought before the Supreme Court should be resolved within 24 months and less if the cases are brought before the lower courts.
Aquino said there is still a case still pending before the Supreme Court since 1961.

Banco Filipino case, et al
Aquino also questioned the Court of Appeals' decision on Banco Filipino and a lower court decision requiring the DPWH to pay P218 million for right of way even if the claimant had used a cancelled certificate of title as a basis of ownership.

"Hindi pa nakuntento ang husgado, naglabas na agad sila ng writ of execution; hindi na nilahinayaan pang marinig ang panig ng gobyerno. Huwag naman sanang nangyari ito dahil lamang may mga nagmamadaling makapagbulsa ng porsyento," he said.

Aquino also criticized the Supreme Court's decision on the formation of an additional legislative district in Camarines Sur, a court decision stopping the trial of the Ruby Rose Barrameda murder case, the Regional Trial Court's injunction in favor of sacked NBI chief Magtanggol Gatdula, among others.

"Gayumpaman, nagpapasalamat na rin po ako dahil TRO lang, at hindi status quo ante order ang inilabas ng RTC. Kung mangyari po ito, sama-sama po tayong magdasal kay St. Jude na sana, talagang inosente lahat ng pinaratangan," Aquino said.

World Bank loan
Aquino also lamented the report released by the World Bank on its loan for the Supreme Court's Judicial Reform Support Project.

"Parang wala ring pinatunguhan ang 21.9 million dollar loan mula sa World Bank, na sana'y naglatag ng komprehensibo at pangmatagalang reporma sa Hudikatura. Dahil dito, malamang, magdadalawang-isip na yan na muling mag-abot ng tulong sa atin. Sino po bang hindi malulungkot? Tinutulungan ka na, sinayang mo pa," Aquino said.
