TUGUEGARAO CITY -- The Department of Labor and Employment–Regional Office No. 2 (DOLE 2) urged "kasambahays" or househelp to report non-compliance of their employers with the 13th month pay provision of Republic Act (RA) 10361, otherwise known as the Domestic Workers Act or Batas Kasambahay.
“Under Rule IV, Section 8 of Batas Kasambahay, one of the rights and privileges of a Kasambahay is 13th month pay,” Atty. Sixto T. Rodriguez, Jr., DOLE 2 Regional Director said.
“A kasambahay who has rendered at least 1 month of service is entitled to 13th month pay which shall not be less than 1/12 of his/her basic salary earned for the year,” Rodriguez added.
As stated in RA 10361, the 13th month pay of kasambahays shall be paid not later than December 24 of every year or upon separation from employment.
