Ombudsman Conchita Carpio Morales said the Supreme Court committed a “radical modification of the Constitution” when it allowed Senator Juan Ponce Enrile to post bail.
In its motion for reconsideration filed last week, Morales argued that the requirements of granting bail was changed by the SC’s controversial decision.
Aside from being a departure from the Constitution, the Ombudsman said the SC ruling on Enrile’s case denied the prosecution and the people “due process” because the “principal and primary” ground of the decision was Enrile’s health, according to a report aired on GMA News TV’s “News to Go” newscast.
She also argued that the SC needs to uphold the “equal protection of the law” when considering whether or not to grant bail pleas.
Voting 8-4, the SC granted Enrile’s bail petition on humanitarian grounds.
The television report quoted Morales as saying that the motion was filed through registered mail last week because the SC was closed on Sept. 4.
