The U.S. Supreme Court on Monday brought to an end a long-simmering dispute over the use of New York City public school space for religious services.
The court denied certiorari in the case Bronx Household of Faith v. Board of Education of the City of New York, in which an evangelical church wants to rent a public school in the Bronx for weekly worship meetings. Justice Sonia Sotomayor, who participated in the case at an earlier stage as a judge on the U.S. Court of Appeals for the Second Circuit, recused herself.
The litigation has gone on for nearly two decades, and the Second Circuit has issued five rulings over the years. “Like most sequels, the opinions keep getting worse,” the petition filed with the high court stated.
The Second Circuit’s most recent decision in 2014 found that the First Amendment’s free exercise clause “has never been understood to require government to finance a subject's exercise of religion.”
